Privacy Policy

Just-for-u Care (JFU Care) respects the privacy of all individuals. We acknowledge and respect each individual's right to privacy and we are committed to maintaining the confidentiality of personal information. JFU Care uses information in line with Privacy Acts and associated legislation to maintain information as confidential.

PROCEDURES

1.Collection of Personal Information

    1.1 To provide service and conduct business, JFU Care are required to collect a range of      personal information. Information is primarily collected to assess, plan and manage client needs in providing services for them. If a client provides incomplete or inaccurate information JFU Care may not be able to provide the services they require.

  1. “Personal information” is any information about an individual whose identity is apparent, or can be reasonably determined from that information, e.g. name, date of birth, etc. “Personal information” also includes sensitive information about individuals, e.g. health information, culture and religion. The types of personal information JFU Care collects will depend on the nature of the association with us.

  2.  Clients–when clients receive services JFU Care may need to collect personal and medical information in relation to client status, occupational health and safety, processes of work, and other relevant information. The information from clients is only used for the purpose for which it was collected in connection with the delivery of services.

  3. Staff  – JFU Care collect personal details from staff including name, address contact details, qualifications, banking details, study, visa/residency status, police records check and other. In some cases, JFU Care will also collect health information about a person’s health and ability. We use information collected from staff only in connection with the delivery of service to clients.

  4. Family and Friends – we need to collect a range of information from staff and clients including, but not limited to next of kin, advocates (formal and informal), carer details. Just- for-u Care use this personal information only when required in relation to service provision and human resource management matters.

  5. Sometimes JFU Care are legally required to collect personal information, including where there is a threat to public health, or in connection with the monitoring of health services provided by JFU Care. Use of personal information in such instances will be in accordance with obligations under applicable privacy and health acts.

  6. Although JFU Care primarily collects personal information to manage clients’ needs in providing service for them, there may be instances where information collected is required to disclose personal information about clients for other related purposes, such as:

  • Meeting government and regulatory requirements in relation to activities such as quality, compliance issue and complaint management

  • Invoicing, billing and account management

4.Use and Disclosure

  1. JFU Care may at times disclose personal information about clients and/or staff where it is necessary to deliver services. JFU Care will not rent, trade or sell personal information about clients and/or staff to third parties. Personal information may only be disclosed outside of JFU Care in circumstances where:

    • Clients have consented to the disclosure

    • Disclosure is in accordance with the purpose for which we collected the information

  2. To meet service needs JFU Care may be required to discuss a client’s personal information with other agencies or service providers. Should this be required the clients consent to share information will be obtained.

 

  1. JFU Care has a legal obligation to disclose personal information, such as to government or under health regulations, or where such disclosure is permitted by law, including under privacy laws.

 

  1. When a Support Worker is used for a Brokered shift – we will only supply the Brokered company with the First Name of the Support Worker.

5.Access and Correction

  1. Staff and clients have a right to request access to personal information that JFU Care holds about them and to update or change personal information about them if it is inaccurate, incomplete or outdated.

  2. An exception to this right is where personal information was collected before 21 December 2001 and has not been used since by JFU Care.

  3. If a staff member or client wishes to exercise their right to seek access to the personal information that JFU Care holds about them, they must contact the Managing Director. Requests for access to personal information must be made in writing stating exactly what personal information you wish to access or correct.

  4. JFU Care will respond to all requests for access to personal information within 14 working days; depending on the type of personal information the staff member or client has requested access to. JFU Care reserves the right to charge reasonable costs for the supply of requested information.

6.Concerns about Privacy

7.Breach of Confidentiality and/or Privacy – Contractor

When/if there is a breach of confidentiality in relation to a contractual arrangement with Just-for-u Care the Contractor will be notified immediately in writing. JFU Care will work with the Contractor to resolve the breach and take appropriate action to protect clients and

 

reduce the likelihood of recurrence.

8.Breach of Confidentiality and/or Privacy – Employee

Any breach of confidentiality/privacy by an employee, will be investigated and may lead to restrictions on employment or the employee may be terminated.

Privacy Incident Reporting

Any breach of privacy is to be reported to the Managing Director and her delegate using the Incident Report form.

A privacy incident may be a breach, a possible breach or a ‘near miss’.

  • Breach or possible Breach – an action or omission that results in loss, theft, misuse or unauthorised disclosure of personal information, or has the potential to do so.

  • Near Miss – are situations where a breach would have occurred without intervention. This includes situations where a privacy incident has occurred without any actual disclosure of personal information.

  • Where a complaint has been made that a privacy breach has occurred, which then needs to be investigated (all allegation of privacy breach).

9.How personal information is stored and destroyed

  1. Clients - JFU Care must retain certain records for clients for the period ending seven years after services are no longer provided. Information is stored electronically. When a client cease using the services of JFU Care, their personal information is archived and then securely deleted from the system seven years later.

  2. Staff – JFU Care retains staff records for seven years post cessation of employment. These records are stored in hard copy in a locked cabinet. Only the HRM Administrator and the Managing Director have access to this information. Information is then destroyed by an external shredding company.

  3. Documents – All documents which are not required to be retained are destroyed by an external shredding company and electronic files are archived on the secure system.
